Terms and Conditions of Service (TCOS)

Make Concepts Ltd. (operating as Horizon Direct) offers you the Horizon remittance service under the following terms and conditions. By using this service, you hereby agree to be bound by the provisions of these Terms and Conditions of Service.

These Terms and Conditions of Service may be amended at any time with the revised provisions and terms posted on the Horizon Direct website. Your continued use of our service after such changes are posted constitutes your acceptance of these Terms and Conditions as amended.

Horizon Direct reserves the right to revise, amend or modify the Payment Options, Fees, Term and Conditions and other policies and agreements at any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with the Terms and Conditions and shall be effective when posted.

Eligibility

You may use the Horizon remittance service if you are at least 18 years old and are based in Canada (we reserve the right to block IP addresses that are located outside of Canada).

Horizon Direct has instituted a policy of limiting all transactions to $999 Canadian Dollars (CAD). If you need to remit more than C$999, please contact our office via phone or email at contact@hdremit.com.

Compliance

Horizon Direct is committed to protecting its business as well as the Canadian financial system from potential money laundering and terrorist financing threats. Horizon Direct is a regulated Canadian Money Service Business operating under the rules set out by the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) and the Proceeds of Crime Money Laundering and Terrorist Financing Act (PCMLTFA). The reputational risk associated with non-compliance of the PCMLTFA and associated regulations is unacceptable to our organization as are administrative monetary penalties that may stem from non-compliance. It is partly for this reason that Horizon Direct has developed and implemented a robust AML/ATF compliance program. While it is common knowledge that some MSB business models may be assessed as high risk, we have instituted policies to reduce such risk (see section below related to products and services and delivery channels). As part of our commitment to protect the Canadian financial system, Horizon Direct has a measured approach to risk tolerance. Our risk tolerance is limited to areas that have a residual risk of moderate or low. While we accept that inherent risk may be high based on predetermined factors related to the general MSB business model, we will only conduct business in areas that can be mitigated to at least a moderate risk. Where the inherent risk and residual risk are both high, Horizon Direct will not offer such services.

Where required under the PCMLTFA, Horizon Direct will ascertain the identity of all clients and/or business relationships. Horizon Direct will conduct transactions only after client identity is established in accordance with its “Know Your Client” (KYC) procedures.

Payment Options

Horizon Direct accepts most bank cards with Interac, VISA debit and Debit MasterCard (MC) logos. VISA debit cards include access cards issued by TD, CIBC, and Scotiabank with a VISA debit logo on the front (typically on the bottom right). You can also pay Horizon Direct using Bill Payments through any of the major banks listed below, either through online banking or in person at the branch. The process is similar to that of paying your utility bills.

To pay in person at one of the banks listed below, you must have an account at said bank and go to a teller. Tell the bank you would like to pay a bill from “Horizon Direct” and give them your HDremit account number - this number is given to you when you sending money using Bill Pay as a payment method and can also be found in your account information (When logged in > hit top right button > “Account”).

Limitation of Service

The maximum remittance amount allowed per transaction is $999 Canadian Dollars, with a maximum remittance amount of $9,500 Canadian Dollars within twenty four (24) hours. Any remittances valued at over $9,500 Canadian Dollars within the 24 hour time frame will be rejected.

Transactions will only be processed when payment has been confirmed. VISA and MasterCard credit or debit cards are typically processed instantly, while payments made through the Bill Payment can take one to three (1 to 3) days.

Horizon Direct shall not be held liable for any adverse actions/consequences instituted by any of the government agencies, and/or billers for payments made on overdue or past due accounts.

All information entered herein must be complete, true and correct. Horizon Direct shall not be liable for any late, erroneous payments or failure in the delivery of payment/s due to errors arising from the details that were provided by the remitter or member of the concerned government agency to which payment or contribution is made. Horizon Direct shall not be liable for any delays or failures in the delivery of payment/s due to Acts of God, weather conditions, fortuitous events and other unforeseen circumstances such as motorcycle breakdown, and courier accident.

Applicable Fees

There are corresponding fees that you have to pay for the service being provided to you. These fees have been indicated prior to your authorization to continue with the transaction. The fees may include the charges made by the payment processor, which have been identified separately from our service fee. Payment processor fees are the fees our payment process charges us to process VISA and MasterCard credit/debit card; these fees are typically set by VISA and MasterCard’s interchange rate plus the payment processors fee. Horizon Direct does not make any profit from the processing of VISA or MasterCard; our commitment is to be as transparent as possible and deliver the best pricing.

Horizon Direct reserves the right to revise, amend or modify these fees any time and in any manner. Notice of any revision, amendment, or modification will be posted in accordance with the Terms and Conditions and shall be effective when posted.

Exchange Rate

The exchange rate posted on the website may fluctuate until such time that the client finalizes the transaction and authorizes payment. The rate and local currency equivalent that will be received by the beneficiary are reflected on the website prior to authorization of payment. The exchange rate offered during the time of transaction may not be equivalent or as competitive as the exchange rate in the foreign exchange market in the Philippines, or the exchange rate quoted by other funds processing and funds transfer agencies and money remittance companies.

Fund Delivery

From the time your remittance payment is verified as credited to the Horizon Direct bank account (typically immediately if paid by VISA or MasterCard credit/debit card, or 1-3 days if paid using Bill Payments), the remittance funds will be paid/credited/delivered to your beneficiary within the committed time, as follows:

Refunds and Cancellation of Transaction

You may request for a cancellation and refund of your remittance transaction provided that the funds have not yet been dispatched to your beneficiary at the time your cancellation request is received by Horizon Direct. Dispatch in this context refers to the time that the remittance transaction instruction leaves Horizon Direct and sent to the paying institution or intermediary (bank, pay-out center, or door-to-door courier). The status of a transaction can be seen in your online transaction tracking and confirmed/verified by Horizon Direct's office. A cancellation request shall require a written notice sent to a cancelations@hdremit.com from your email address registered on file, along with the details of the transaction that are required for cancellation. A refund may also be requested for transactions that have not been delivered due to incorrect/incomplete beneficiary information, and other uncontrollable factors. Only the principal amount may be refunded. Refunds will be made within thirty (30) days of receipt of a valid cancellation request.

Under no circumstances can a cancellation or refund be accommodated once the funds transfer/delivery has been completed.

Privacy and Collection of Information

This Privacy Policy relates solely to information supplied by you on this Web Site.

Privacy Commitment

As our valued client, your privacy is important to us. We respect the privacy of your personal information and will treat it confidentially and securely. We shall not provide or sell your personal information and details to third parties unless you have specifically requested that we do so, in order that these advertisers and/or third parties can offer you information, goods and services that may be of interest to you. Any information provided by you to Horizon Direct through this Web Site will be used for the purpose of providing and operating the products and services you have requested at this Web Site and for related purposes which may include updating Horizon Direct's records, understanding your financial needs, advising you of other products or services which may be of interest to you, for crime and fraud prevention, and for purposes required by law or regulation.

We will use the information that you communicate to us within the bounds of all applicable laws, and rules and regulations and such information will not be revealed by Horizon Direct to any external body, unless Horizon Direct has your permission, or is under a legal obligation or any other duty to do so. For the purposes herein mentioned, your information may be disclosed to (i) other branches or companies of Make Concepts, its subsidiaries and affiliates; (ii) any regulatory, supervisory, governmental or quasi-governmental authority with jurisdiction over Make Concepts; (iii) any agent, contractor or third party service provider, professional adviser or any other person under a duty of confidentiality to Make Concepts; (iv) any actual or potential participant, assignee, or transferee of, any of Make Concepts’ rights and/or obligations in relation to you; and (v) the financial institutions in which Make Concepts has or proposes to have dealings.

Compliance Commitment

As per Horizon Direct’s AML/ATF compliance program we are required to collect, verify and, in selected cases, disclose certain personal information to authorities, where “personal information” is information about an identifiable individual, as more particularly defined or limited under applicable Canadian privacy legislation or that of other jurisdictions.

Information collected shall be used mainly to facilitate the processing of your transaction. Your personal information will not be used or disclosed for purposes other than those for which it has been collected, except with your consent, or unless we are required by law to do so. FINTRAC requires that we retain your information for a period of five years from the date of your last remittance. While we have your information, we will safeguard your information according to established industry security standards and provisions of The Personal Information and Protection of Electronic Documents Act of Canada ("PIPEDA").

Information we collect

In line with service requested, we will need you to provide your full name, contact information such as telephone number and email address, send amount for the intended beneficiary.

We will also need you to provide similar information on your intended beneficiary, including bank account details, home address and/or fund pick-up preference. This information is necessary for us to deliver the funds as instructed.

In addition to the personal information you provide us via our Web sites or by other methods - the collection, disclosure or use of which is as set out in this Privacy Policy – we will also collect electronic information, which does not include personal information, when you access our Web sites. The electronic information we collect may include (but not limited to):

We do not collect information pertaining to your credit card or debit card (such as the card's expiry date) - any information pertaining to your credit card or debit card will handled by a third party payment processor. This third party processor may also collect information from credit card or debit card authorization services to verify the information you provide when you attempt to send money online through our website.

Indemnity

You agree to indemnify and hold Horizon Direct, its affiliates, agents, partners, officers and employees harmless and free from any claim, demand or any liability, including reasonable attorney's fees arising out of or in connection with the use or connection of the Service provided or any part thereof or otherwise arising in relation to any breach of these terms and conditions by you.

Limitation of Liability

In no event shall Make Concepts (operating as Horizon Direct), its subsidiaries, employees or our suppliers be liable for lost profits or any special, incidental or consequential damages arising out or in connection with our web site, our service, or this agreement (however arising, including negligence). Our liability, and the liability of our parent, subsidiaries, employees and suppliers, to you or any third parties in any circumstance is limited to the actual amount of direct damages.

No Warranty

The service offered herein are provided on "AS IS" basis and without any warranty or condition, express, implied or statutory and specifically disclaim any implied warranties of title, merchantability, fitness for a particular purpose and non-infringement. Horizon Direct shall make reasonable efforts to ensure that requests for electronic debits and credits involving bank accounts, are processed in a timely manner, but we make no representations or warranties regarding the amount of time needed to complete processing because our service is largely dependent upon many factors outside of our control, such as delays in the banking systems or validation from our third party processor. Some states/provinces do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you. This warranty gives you specific legal rights and you may also have other legal rights that vary from state to state.

Access and Interference

You agree that you will not use any robot, spider, other automatic device, or manual process to monitor or copy our web pages or the content contained herein without our prior expressed written permission. You agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Horizon Direct Horizon Direct site or any activities conducted on our site. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our infrastructure. Much of the information on our site is proprietary or is licensed to Horizon Direct by our users or third parties. You agree that you will not copy, reproduce, alter, modify, create derivative works, publicly display or frame any content from our web site without the prior expresses written permission of Horizon Direct or the appropriate third party. If you use, or attempt to use the Service for purposes other than sending and receiving payments and managing your account, including but not limited to tampering, hacking, modifying or otherwise corrupting the security or functionality of Service, your account will be terminated and you will be subject to damages and other penalties, including criminal prosecution where available.

Intellectual Property

Horizon Direct and related logos, products and services posted in this website are proprietary to Horizon Direct Incorporated or International Remittance Canada Ltd. These may not be copied, reproduced, imitated or used, in whole or in part, without the consent and permission from the owner.

Electronic Signature Content

You agree that providers may provide you with all disclosures, notices, and communications solely in electronic form. Providers reserve the right to provide communications in paper form at any time though they are under no obligation to do so. All communications, whether in electronic or paper form, will be considered "in writing" for the purposes of applicable law. If you do not want to receive communication in an electronic form, you may not use the service. Hardware and software requirements for the service include the ability to access our site via the internet. If a change in hardware or software is necessary, you will be notified electronically.

Jurisdiction

This terms and conditions will be governed by the laws of Ontario and Canada and the parties agree to submit to the exclusive jurisdiction of the Ontario or Canadian Courts.

General Information

These Terms and Conditions of Service (TCOS) constitute the entire agreement between you and International Remittance Canada Ltd. (Horizon Direct) and govern your use of the Service, superseding any prior agreements between you and Horizon Direct. You also may be subject to additional terms and conditions of Third Parties such as your depository bank. The failure of Horizon Direct to exercise or enforce any right or provision of the TCOS shall not constitute a waiver of such right of provision. If any provision of the TCOS is found by an arbitrator or court competent jurisdiction to be invalid, the party nevertheless agrees that the arbitrator or court should endeavor to give appropriately valid effects to the intention of the TCOS as reflected in the provision, and the other provisions of the TCOS shall remain in full force and effect. The available Destination Country is for the Philippines only. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or the TCOS must be filed within one (1) year after such claim or cause of action arose or be forever barred.

Accuracy of Information

You agree to provide true and accurate information as required in the registration form about yourself and to promptly update the data whenever necessary to keep it true and accurate. If you provide information that is not true or accurate, Horizon Direct has the right to suspend or terminate your account and/or disallow you from using the services. You agree to provide complete and accurate information about the beneficiary necessary to effect successful delivery of your remittance. Horizon Direct shall not be held accountable for failure of delivery due to erroneous or fictitious beneficiary information.

Web Servers

We use web server log files in administration of the website. This includes IP addresses, browser type, ISP, referring/exit page platform type, date and time stamp and number of visits to analyze trends and gather demographic information about our clients, their interests and needs.

How We Use Client Information

We use the collected information to render the service of transferring funds which was coursed through us. This information shall not be shared or disclosed to outside parties, except as described above under Privacy Commitment, unless required to provide those services mentioned.

We may perform statistical analyses of user behaviour in order to measure relative consumer interest for product development purposes Personal information on individual clients will not be provided in the result of these statistics. We may periodically send you email updates Horizon Direct's products and services. Only those users who have opted in to receive these communications through email will receive this information. If you wish to opt out of receiving such information from us, please use the unsubscribe option included in all our email correspondence or send an email to communications@hdremit.com stating that you would prefer not to receive such mailings.

Data Security

We have established the appropriate physical, electronic, and managerial procedures to safeguard and secure the information we may collect online to prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of information in order to provide you the service we have committed.

Horizon Direct's systems are developed and operate around established security standards and technology to protect your information against identified risks - known computer viruses and Internet hackers. We combine these with internal procedures to provide you a secure transaction connection through encryption, authentication, message integrity, and non-repudiation.

In order to maintain the security of our systems, protect our staff, records, and transactions, and, in certain circumstances, to prevent and detect crime or unauthorized activities, Horizon Direct reserves the right to monitor all Internet communications including Web and email traffic into and out of its domains.

Use of Cookies

A cookie is a small, numeric text file that is stored by your browser on your computer's hard drive. Any information you provide to us is held securely on our web servers and not on your machine. We may also use cookies to track users as they browse through the website. The use of cookies in this way helps to make our systems more efficient. Cookies do not enable us to gather personal information about you unless you give the information to our server.

Privacy Limitation

This privacy policy applies only to information gathered through this website. We have no responsibility or bearing to the policy of other websites linked to ours. This Privacy Policy is not intended to, nor does it, create any contractual rights whatsoever or any other legal rights, nor does it create any obligations on Horizon Direct in respect of any other party or on behalf of any party.

Notification of Changes

We will post any policy changes and revisions on the website so that clients are always aware of the current privacy practice being implemented.
